Agreement & Acceptance of Terms

These SMS Terms and Conditions ("SMS Terms") govern the provision and use of text messaging (SMS and MMS) services offered by Upboard LLC ("Upboard," "we," "us," or "our"). By receiving text messages from Upboard, you agree to be bound by these SMS Terms and our SMS Privacy Policy. If you do not agree to these terms, you may text STOP to cancel at any time.

Program Description & Message Content

The Upboard SMS Program delivers automated and manual text messages in support of our employee onboarding platform. Upboard sends these messages on behalf of its business customers (employers) to their employees who have been enrolled in an onboarding program. Messages sent under this program may include:

• Welcome announcements to newly hired employees at the start of their onboarding.
• Reminders for scheduled onboarding activities, such as training sessions, surveys, and check-ins.
• Updates regarding the employee's onboarding progress.
• Direct responses to inbound questions, support inquiries, or opt-out and help requests.

All messages sent under this program are transactional onboarding notifications. No marketing or promotional content is sent under this program.

Enrollment & Consent

You receive messages under this program because your employer or the organization enrolling you (an Upboard business customer) provided your mobile phone number during onboarding enrollment in the Upboard platform. Employees are informed at enrollment that they will receive onboarding communications.

Receiving SMS messages is not a condition of employment or of purchasing any goods or services. You represent that you are the account holder or an authorized user of the mobile phone number provided by the enrolling organization. If you are not the intended recipient, please contact us and text STOP to cancel.

Message Frequency

Message frequency varies based on your onboarding schedule as configured by the enrolling organization. You may receive multiple messages during active onboarding periods, such as your first days and weeks of employment. Outside of scheduled onboarding activities, messages are infrequent.

Cost & Message Rates

Upboard does not charge a separate fee for sending or receiving text messages; however, message and data rates may apply from your mobile carrier according to your individual mobile service plan. You are solely responsible for any messaging or data fees assessed by your wireless carrier.

How to Opt-Out

Reply STOP to any text message from Upboard at any time. You can also text CANCEL, QUIT, END, or UNSUBSCRIBE to [Phone Number: TBD]. After texting STOP, you will receive a single confirmation message confirming that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages from us unless you explicitly re-subscribe. Opting out of SMS does not affect your onboarding program or email communications.

Supported Carriers & Carrier Disclaimer

Our text messaging service is compatible with major mobile carriers in the United States, including but not limited to AT&T, Verizon Wireless, T-Mobile, Boost Mobile, Cricket Wireless, Metro by T-Mobile, and U.S. Cellular. Compatible carriers may change at any time without notice. Mobile carriers are not liable for delayed or undelivered messages, and no carrier guarantees message delivery.

Eligibility

The Upboard SMS Program is directed to employees of organizations that use the Upboard platform. By participating, you represent that you are at least eighteen (18) years of age (or have reached the age of majority in your jurisdiction) and have the authority to agree to these SMS Terms and incur any charges from your mobile carrier.

Privacy

Your privacy is important to us. Please review our SMS Privacy Policy for full details on how we collect, handle, and safeguard your personal information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Disclaimers & Limitation of Liability

The SMS service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Upboard is not responsible for any delays, delivery failures, or errors in transmission resulting from telecommunications network disruptions, carrier limitations, or signal coverage.

Changes to SMS Terms

We reserve the right to modify or terminate the SMS messaging service or these SMS Terms at any time. Any changes will become effective immediately upon posting to this page with an updated date. Your continued participation in the SMS program following any modifications signifies your acceptance of the updated terms.
